Rental Agreement & Terms of Service

The customer is responsible for all rented totes, dollies, and related equipment from the time of delivery until pickup is completed by North Texas Tote Co.

All equipment must be returned in substantially the same condition in which it was delivered, excluding normal wear and tear resulting from ordinary use.

Customers are responsible for any rented equipment that is lost, stolen, damaged beyond normal wear and tear, or otherwise not returned. Replacement charges are as follows:

• Tote (Bin & Lid): $10 per tote
• Tote Dolly: $75 per dolly

The customer authorizes North Texas Tote Co. to charge the payment method on file for any applicable replacement or damage fees.

Equipment must be available for pickup on the scheduled pickup date unless an extension has been approved in advance. If equipment is not ready for pickup on the scheduled date, or if the rental period is extended without prior approval, the following fees may apply:

Dolly Rentals

• Standalone Dolly Rental: $40 per additional week or $6 per day
• Dolly Add-On with Tote Package: $20 per additional week or $3 per day

Customers needing additional rental time should contact North Texas Tote Co. before their scheduled pickup date. Extensions are subject to availability.

All totes and equipment must be:

• Completely empty
• Reasonably clean
• Easily accessible for pickup
• Located at the agreed-upon pickup address

If equipment is not accessible or pickup cannot be completed as scheduled, additional service or rescheduling fees may apply.

Rental equipment may not be used to store or transport:

• Hazardous or flammable materials
• Chemicals or toxic substances
• Liquids that are not properly sealed
• Illegal items
• Materials that may damage the equipment

Customers are responsible for any damage resulting from misuse, negligence, or unauthorized use of the equipment.

The customer acknowledges that moving and storage activities involve inherent risks.

To the fullest extent permitted by law, North Texas Tote Co., its owners, employees, and representatives shall not be liable for any injury, loss, damage, expense, or claim arising from or related to the use, handling, transportation, loading, unloading, or storage of rented equipment.

Customers assume all responsibility for the safe use of the equipment by themselves and any person to whom they provide access. Nothing in this agreement shall waive any liability that cannot legally be limited or excluded under applicable law.

All rental equipment is delivered in clean, functional, and serviceable condition. Acceptance of delivery constitutes acknowledgment that the equipment was received in satisfactory condition unless reported within 24 hours of delivery.

Equipment not returned within thirty (30) days of delivery, and for which no extension has been approved, may be considered permanently unreturned. North Texas Tote Co. reserves the right to charge replacement costs for all unreturned equipment as outlined in Section 2.

If equipment is later recovered and returned in acceptable condition, any refund of replacement charges shall be issued solely at the discretion of North Texas Tote Co.

Voluntarily submitted reviews, photos, and testimonials may be used for marketing unless otherwise requested.

The customer agrees to defend, indemnify, and hold harmless North Texas Tote Co., its owners, employees, and representatives from any claims, liabilities, damages, costs, or expenses arising from:

• The customer's use of the equipment;
• The acts or omissions of any person using the equipment with the customer's permission; or
• The customer's violation of this agreement.

If any provision of this agreement is determined to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

This agreement shall be governed by and construed in accordance with the laws of the State of Texas.

By checking the acceptance box during checkout, placing an order, or accepting delivery of rental equipment, the customer acknowledges that they have read, understood, and agree to be bound by the terms of this Rental Agreement and Terms of Service.
